Breast Cancer Misdiagnosis Spurs Medical Malpractice Lawsuit : Victim Sues After Amputation Performed

A lawsuit has been filed against an Illinois physician and NorthShore University HealthSystem for allegedly misdiagnosing patient with breast cancer and removing a breast that was later shown not to be cancerous.

According to the personal injury lawsuit, the victim’s doctor submitted tissue for biopsy which was examined by Dr. Robert Goldschmidt. The diagnosis returned was “invasive breast cancer”. The physician of the victim relied upon the accuracy of the pathology report and recommended mastectomy surgery at Rush North Shore Medical Center.

“A pathology report was issued by Rush North Shore Medical Center indicating that the surgical specimen was negative for malignancy,” the lawsuit states. The lawsuit further stated that an independent review by the hospital showed that the victim did not have breast cancer.

The lawsuit filed by the couple’s personal injury attorney accuses the physician who prepared the pathology report and the hospital of medical negligence, personal injury, improper diagnosis of cancer, loss of consortium and institutional negligence. The personal injury suit also alleges damages for injuries of a “personal and pecuniary” nature.

Former patient says that insurance company failed to refund co-payment after victim collected under personal injury award. Plaintiff in the case suffers small, individual damages, but class action status of lawsuit could possibly affect thousands of medical insurance customers

The victim was awarded $4,250 in damages in a lawsuit filed by personal injury attorney against the driver. Kaiser’s policy states that, when a medical insurance customer collects damages in a personal injury lawsuit, the insurance company may file to seek reimbursement of its costs. The insurance company did this, but did not credit the victim for an initial $20 co-payment.

The lawsuit was filed in the State of California court in May 2009.
